Fitzgerald Submits Legislation & Appointments to Council

PITTSBURGH – County Executive Rich Fitzgerald submitted five bills to County Council for consideration at its upcoming meeting:

  • Resolution amending the Allegheny County Health Department Rules & Regulations, Air Pollution Control, to add a visible emissions standard for coke ovens and coke oven gas. Specifically, the changes would (1) add the term “soaking emissions from a standpipe cap” since the term is included in the subsection; and (2) adding a subsection to include the soaking operation which involves heating the coal in the ovens to produce coke.  There are federal requirements for operational procedures; this addition would allow for a quantifiable compliance mechanism.

  • Resolution amending the Allegheny County Health Department Rules & Regulations, Air Pollution Control, under operating permits and applications to provide clarity on when the 30-day public comment period and the EPA Administrator’s 45-day review period are concurrent or sequential. The revision also provides that substantive comments or material substantive changes to a permit during the public comment process shall prompt the re-submittal process, where the EPA review period begins after the public comment period has ended.

  • Resolution amending the Allegheny County Health Department Rules & Regulations, Air Pollution Control, to remove a phrase in the SIP revision that the U.S. Environmental Protection Agency could not approve.  The revision removes “…except if such person is lawfully temporarily relieved of the duty to comply with such requirements” from Subsection 2012.07.d. Violation.

  • Resolution amending the Allegheny County Health Department Rules & Regulations, Air Pollution Control, to add a new subsection to implement a notification system for natural gas wells in unconventional formations. The regulation will place requirements on shale gas well operators to report to the Health Department prior to the start of four milestone activities in the development of an unconventional shale gas well:  initial well site construction, drilling, hydraulic fracturing and flaring. This reporting will enable enforcement staff to properly enforce existing air quality regulations in the county.

  • Resolution amending the Allegheny County Health Department Rules & Regulations, Air Pollution Control, to provide revisions to Ambient Air Quality Standards and Remedies/Enforcement Orders.  The proposed changes to the Ambient Air Quality Standards will remove the existing list of National Ambient Air Quality Standards (NAAQS) and incorporate, by reference, all NAAQS listed in the Clean Air Act and the Air Pollution Control Act so the most current standards are referenced.  The revisions to Remedies/Enforcement Orders updates language to reflect current home rule officials and divisions within the Department.  It also authorizes the Manager of the Air Quality Program (or designee) to sign enforcement orders give by the Air Quality Program.
